Terms of use

These terms govern your use of tristaradvanced.com (the "site"), operated by Tristar Advanced Software, LLC ("Tristar Advanced Software", "we", "us"). By using the site, you agree to them. If you don't agree, please don't use the site.

Our software

Software you download from the site is governed by the license agreement that comes with it, not by these terms. If the two conflict on anything about the software, the license agreement wins. Purchases are governed by the terms presented when you buy.

Support

We provide support, by support ticket, in English only. Please write to us in English.

Your account

• You must be at least 16 to create an account.
• Keep your account details accurate, and keep your password and two-factor codes to yourself.
• You're responsible for what happens under your account. Tell us straight away if you think someone else has used it.
• Don't share, publish or resell license keys, except as your license agreement allows.

Acceptable use

Don't:

• try to get into accounts, systems or data that aren't yours;
• interfere with or overload the site, or get around its security or usage limits;
• guess, generate or test license keys, or otherwise try to get around licensing;
• scrape the site, or use it to break the law or anyone's rights.

Our content

The site and its content, including text, images, logos and product names, belong to us or our licensors and are protected by intellectual property laws. You may view and print pages for your own use, but not copy, change or distribute them without our permission.

Export and sanctions

Our software is subject to United States export control and sanctions laws. You may not download, use or export it in violation of those laws, including to a country, region or person subject to US embargo or sanctions. By downloading it, you confirm you're not such a person or located in such a place.

Suspension and closing accounts

We may suspend or close an account that breaks these terms or puts the site or other users at risk, and will tell you why unless the law or security prevents it. You can ask us to close your account at any time. Closing an account doesn't end licenses already granted, which follow their license agreement.

Disclaimer

We work to keep the site available and accurate, but provide it "as is" and "as available", without warranties of any kind, to the fullest extent the law allows. We don't promise it will always be available, uninterrupted or error-free.

Limitation of liability

To the fullest extent the law allows, we aren't liable for indirect, incidental, special or consequential losses, or for lost profits, data or business, arising from your use of the site, and our total liability for any claim about the site is limited to US$100.

Your statutory rights

Nothing in these terms limits rights you have by law that can't be waived or limited by contract, such as consumer rights where you live, or our liability for death or personal injury caused by negligence, or for fraud. Where such laws apply, the disclaimer and limitation of liability above apply only as far as they allow.

Privacy

Our privacy policy explains how we handle your personal information.

Governing law

These terms are governed by the laws of the State of Ohio, USA, and disputes go to its courts. If you're a consumer living elsewhere, you keep the protection of the mandatory laws of where you live, and may bring claims in your local courts.

Changes to these terms

We may update these terms. We'll post the new version here and update the effective date, and let account holders know by email about significant changes. Changes apply from then on, not to past use.
